These Terms & Conditions (“Terms”) govern your access to and use of https://trendyxpressbd.com/, our social pages, and any services we provide (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy & Cookies Policy and Refund & Return Policy (together, the “Policies”). If you do not agree, please do not use the Services.

2) Eligibility & account

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order.
  • You may create an account. Keep your credentials confidential and notify us immediately of any unauthorized use.
  • We may refuse service, close accounts, or cancel orders at our discretion where permitted by law.

3) Changes to the Terms

We may update these Terms from time to time. Changes are effective when posted with the “Last updated” date above. Your continued use of the Services after changes means you accept the updated Terms.

4) Orders & acceptance

  • Your order is an offer to buy. We’ll confirm receipt by email/notification, but acceptance occurs only when we dispatch the product or otherwise confirm acceptance.
  • We may cancel or refuse any order (e.g., suspected fraud, stock errors, pricing mistakes, shipping restrictions). If payment was taken, we’ll issue a prompt refund.

5) Pricing, promotions & errors

  • Prices, offers, and availability are subject to change without notice.
  • Despite our best efforts, errors may occur. If we discover an error in pricing/availability, we may cancel the order or contact you for instructions before dispatch.
  • Coupons, points, and promotional credits have stated terms and expiry dates; they are non-transferable and may not be combined unless stated.

6) Payment

  • We accept the payment methods shown at checkout (e.g., bank cards, mobile wallets, Bkash/Nagad, COD, EMI).
  • For COD, payment is due at delivery. Refusal of a legitimate shipment may affect your ability to use COD in the future.
  • Payments are processed by third-party providers. We do not store full card numbers. You authorize us to charge your selected method for your order total and applicable fees/taxes.

7) EMI terms (if offered)

  • EMI is provided by participating banks/payment partners and subject to their approval and terms.
  • Processing fees/interest, minimum cart value, tenure options, early closure rules, and refund handling follow our EMI Terms page.
  • If an EMI order is refunded, bank/partner rules apply; some charges may be non-refundable.

8) Shipping, risk & delivery

  • We ship to the areas shown at checkout. Estimated delivery times are estimates, not guarantees.
  • Title and risk of loss pass to you upon delivery to your address or pickup by your carrier (according to applicable law).
  • Please inspect parcels on delivery. If damaged/short, report within 48 hours with photos/video.
  • Additional services (installation, demo) are provided where available and may incur extra fees.

9) Returns, refunds & warranty

  • Our Refund & Return Policy explains your return window, DOA/damage rules, non-returnable items, and refund timelines.
  • Many products include a manufacturer warranty; after the return window, issues are handled per the warranty terms (exclusions may apply).
  • Nothing in these Terms affects your statutory rights under applicable consumer law.

10) Product information

  • We strive for accuracy, but colors/specifications may vary slightly from images due to display settings or minor model revisions.
  • Accessories shown in photos may be for illustration unless stated as included.
  • Software/digital products and license keys are non-returnable once delivered/activated except where defective on arrival.

11) User content & reviews

  • If you submit reviews, comments, photos, or other content, you grant TrendyXpress a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, display, and distribute such content for operating and promoting the Services.
  • You represent that your content is accurate, lawful, and does not infringe third-party rights or include harmful/obscene material.
  • We may moderate or remove content at our discretion.

12) Acceptable use

You agree not to:

  • Violate any law, infringe IP or privacy rights, or engage in fraud.
  • Interfere with site security, attempt to access accounts without authorization, or upload malware.
  • Use automated means (bots/scrapers) to extract data without written consent.
  • Misuse coupons, referral credits, or loyalty points.

13) Intellectual property

All content on the Services—text, graphics, logos, icons, photos, videos, product names, software, and the overall look and feel—is owned by TrendyXpress or its licensors and protected by IP laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

14) Third-party links & services

The Services may include links to third-party websites, apps, payment gateways, or social platforms. We are not responsible for their content, policies, or practices. Use them at your own risk and review their terms.

15) Privacy & cookies

Your use of the Services is also governed by our Privacy & Cookies Policy, which explains how we collect, use, and share your information and how we use cookies, pixels, and similar technologies.

16) Disclaimer of warranties

Except as expressly stated, the Services and all products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free, or fully secure operation.

17) Limitation of liability

To the maximum extent permitted by law, TrendyXpress will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, data, goodwill, or business interruption) arising out of or related to the Services or products, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

Some jurisdictions do not allow certain exclusions/limitations; in those cases, our liability will be limited to the maximum extent permitted.

18) Indemnity

You agree to indemnify and hold harmless TrendyXpress, its directors, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party rights.

19) Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, epidemics, labor disputes, war, government actions, power or internet failures, or courier disruptions.

20) Suspension & termination

We may suspend or terminate your access to the Services if you violate these Terms or if required by law. You may close your account at any time. Sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity, governing law) will survive termination.

21) Communications & electronic records

By using the Services, you consent to receive communications from us electronically (email, SMS, app notifications, or messages via platforms like Facebook/WhatsApp). You agree that electronic communications satisfy any legal requirement for written communications.

22) Governing law & disputes

These Terms are governed by the laws of Bangladesh without regard to conflict-of-laws principles.

  • Venue: You agree to the exclusive jurisdiction of the courts located in Dhaka.
  • Informal resolution first: Contact us at support@trendyxpressbd.com within 30 days of the issue; we’ll try to resolve it informally.
  • If your local consumer law grants you additional mandatory rights, those rights remain unaffected.

23) Miscellaneous

  • Severability: If a provision is unenforceable, the remainder remains in effect.
  • No waiver: Our failure to enforce a provision is not a waiver.
  • Assignment: You may not assign your rights or obligations without our consent. We may assign as part of a merger, acquisition, or sale of assets.
  • Entire agreement: These Terms plus the Policies are the entire agreement between you and us regarding the Services.
